    NOTICE IS HEREBY GIVEN that the Florida Department of Economic Opportunity issued Final Order No.: DEO-14-006 on January 21, 2014 in response to an application submitted by Turkey Roost Mini-Farms Homeowners Association, for covenant revitalization under Chapter 720, Part III, Florida Statutes.

    The Department determined that the application for Turkey Roost Mini-Farms Homeowners Association did not meet the statutory requirements for covenant revitalization due to the covenants being more restrictive than the previous version, in violation of Section 720.404(3), F.S., which provides that [t]he revived declaration may not contain covenants that are more restrictive on the parcel owner than the covenants contained in the previous declaration, with limited exceptions that do not apply to the revised covenants submitted by Turkey Roost Mini-Farms Homeowners Association. The Turkey Roost Mini-Farms Homeowners Association revived declaration contains a provision that is more restrictive than the original covenants.

    Accordingly, the Departments Final Order denied the application for covenant revitalization.
