NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of State Fire Marshal, has received the petition for declaratory statement from Eric Busenbarrick, Deputy Fire Chief, Hollywood Fire Rescue and Beach Safety Department, on January 16, 2014. The petition seeks the agency’s opinion as to the applicability of National Fire Protection Association 101, sections 7.1.9 and 7.1.10.1 as it applies to the petitioner.
The subject of the Petition is a burglar alarm system that when activated fills the occupancy with synthetic smoke to obscure visibility and notifies the central monitoring station. The Petition seeks the agency’s opinion as to the applicability of National Fire Protection Association 101, sections 7.1.9 and 7.1.10.1, which are adopted in the Florida Fire Prevention Code, to installation of burglar alarms and if applicable, can the Fire Marshal deny installation of such systems because they violate these two sections that require means of egress to be unobstructed by any device or alarm.
