The Department of Highway Safety and Motor Vehicles hereby gives notice:
That Robert Willis’ Petition for Permanent Variance from the Provisions of F.A.C. Rule 15A-5.011(5), filed on September 25, 2017, notice published in the F.A.R. on October 10, 2017, is Denied. The Final Order denying permanent variance was issued on January 18, 2018.
Petitioner has failed to demonstrate that the purpose of the underlying statute will be or has been achieved by other means. Specifically, he has not demonstrated that the issuance of a driver license would not be detrimental to public safety and welfare as provided in section 322.05(10), F.S.
