    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 48 No. 181, September 16, 2022 issue of the Florida Administrative Register.

    The changes are based upon comments submitted by the Joint Administrative Procedures Committee and discussion and subsequent vote by the Board at the public meeting held December 5, 2022, in Orlando, Florida.

    The rule now reads as follows:

    61J1-2.0025 Appraisal Management Company Annual Report.

    (1) No change.

    (2) In accordance with the provisions contained in 12 U.S.C. 3338, on an annual basis, each authorized representative or controlling person of an Appraisal Management Company (AMC) registered with the State shall submit an Annual Report to the Department on DBPR form FREAB 5 Appraisal Management Company ‒ Annual Report (effective 12/2022 8/2022), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref_______or http://www.myfloridalicense.com/dbpr/re/documents/FREAB5.pdf.

    (3) through (6) No change.

    The following changes have been made to page 5 of the incorporated form DBPR FREAB-5, Appraisal Management Company ‒ Annual Report:

    • The title of the page “Affirmation of Written Declaration” has been changed to “Signature Page”.
    • In the first line (Note), the word “sign” has been changed to “execute this”.
    • Throughout the page, the words “Affirmation by Written Declaration” have been replaced with the words “Signature Page”.
    • The phrase “written declaration has the same legal effect as an oath or affirmation” has been removed.
    • The word “affirms” has been changed to “states”.
