    69D-1.003Review Process and Reward Criteria

    PURPOSE AND EFFECT: Pursuant to subsection 626.9892(2), F.S., the Department is authorized to pay rewards of up to $25,000 to persons providing information leading to the arrest and conviction of persons committing certain enumerated crimes that are investigated by the Department. Chapter 2016-132, Laws of Florida, amended subsection 626.9892(2), F.S., to add additional crimes including violations of Sections 790.164, 790.165, 790.166, 806.031, 806.10, 806.111, and 817.233, F.S.

    SUMMARY: Updating Rule 69D-1.003, F.A.C., to conform with statutory changes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department conducted an economic analysis of the potential impact of the proposed rule and determined that there will be no adverse economic impact or regulatory increases that would require legislative ratification.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    (5) A reward may only be given if information was submitted by an applicant to the Division of Investigative and Forensic Services on or after October 1, 1999, and such information led to the arrest and conviction of a person who committed a complex or organized crime investigated by the Division arising from a violation of Sections 440.105, 624.15, 626.9541, 626.989, 790.164, 790.165, 790.166, 806.031, 806.10, 806.111, 817.233, or 817.234, F.S. In determining the amount of the reward to be awarded, the Department will consider the factors in subsections 69D-1.003(7) and (8), F.A.C.

    (6) through (10) No change.
