NOTICE IS HEREBY GIVEN that the South Florida Water Management District has received the petition for declaratory statement from J. Tucker, Trustee. The petition seeks the agency's opinion as to the applicability of "whether the District has the authority to pursue penalties for the uncontroverted perjury by the City of Sunny Isles Beach" as it applies to the petitioner.

Petitioner alleges the City of Sunny Isles Beach committed "perjury" when it executed District Form 0971, which is the application for environmental resource permit, claiming to be the owner of the real property. This petition pertains to Permit No. 13-05435-P, Application No. 090408-3 to the City of Sunny Isles Beach. This notice supplements the notice of January 22, 2014, Volume 40, Number 14, Florida Administrative Register.
