  • NOTICE IS HEREBY GIVEN THAT the Department of Community Affairs has received the petition for declaratory statement from Larry M. Schneider, AIA, on November 16, 2010. It has been assigned the number DCA10-DEC-285. The petition seeks the agency's opinion as to the applicability of section 11.2.2, Florida Accessibility Code, as it applies to the petitioner.
    The Petitioner asks that the Commission issue a declaratory statement determining that the Petitioner may substitute the 2010 ADA Standards that were adopted and published on September 15, 2010, by the U.S. Department of Justice, and that the use of these standards may be considered a departure from particular technical and scoping requirements that will provide substantially equivalent or greater access and usability of the facility. The Petitioner would, in addition, follow the Florida specific requirements of Section 553.504, F.S. The construction work for which the Petitioner seeks a declaratory statement is being performed pursuant to a settlement agreement in a federal ADA lawsuit, and is scheduled to take place over the next 48 months.
