62-610.462Reliability and Operator Staffing

The Department of Environmental Protection hereby gives notice:

that a Final Order was issued on January 22, 2019, granting North Key Largo Utility Corporation’s Petition for a Variance (Petition). The Petition was received on December 21, 2018. The petition requested a variance from subsection 62-610.462(3), F.A.C., which requires the minimum staffing requirement at the wastewater treatment facility to be a Class C or higher operator 6 hours per day, 7 days per week. In lieu of the rule, the staffing requirement at the facility will be a Class C or higher operator 6 hours per day, 5 days per week, and one visit of one hour duration during the weekend. No public comment was received. The Final Order, file number FLA015009-009-DWF; OGC No. 18-1508, granted the Petition because the Petitioner demonstrated that a strict application to the rule would result in substantial hardship to Petitioner and the purpose of the underlying statutes will be achieved by other means. Notice of receipt of the Petition was published in the Florida administrative Register on January 11, 2019.
