  • Notice of Entry of Final Orders Revising Verified Lists of Impaired Waters and Delisting of Waters

    The Department of Environmental Protection gives notice that, pursuant to Section 403.067(4), F.S., and Chapter 62-303, F.A.C., two final orders were entered on January 15, 2010, revising the Verified Lists of Impaired Waters for the Group 3 Basins and amending the previously adopted lists for the Group 1, Group 2, and Group 5 basins. In addition, certain waters were delisted within each basin. The Group 3 basins include the following: Choctawhatchee-St. Andrews Bay, Upper St. Johns River, Sarasota Bay-Peace River-Myakka River, Caloosahatchee, and Lake Worth Lagoon-Palm Beach Coast. Amendments were made to the following Group 1 basins: Everglades West Coast, Lake Okeechobee, Ochlockonee/St. Marks, Ocklawaha, Suwannee/Santa Fe, and Tampa Bay. Amendments were also made to the following Group 2 basins: Apalachicola-Chipola, Tampa Bay Tributaries, Charlotte Harbor, Middle St. Johns River, and Lower St. Johns River. The Group 5 amendments included waters in the following basins: Everglades, Indian River Lagoon, and Upper East Coast. These revisions/amendments will be submitted to the United States Environmental Protection Agency (EPA) pursuant to Section 303(d) of the federal Clean Water Act and shall serve to update the previously approved Section 303(d) list of Florida waters.

    A person whose substantial interests are affected by these final orders may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S., in accordance with the full notice of rights language contained in each final order. The petition, which must contain the information identified in the full notice of rights language contained in the final order, must be filed (received by the clerk): Department’s Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station #35, Tallahassee, Florida 32399-3000, within 21 days of publication of this notice or within 21 days of receipt of the written notice, whichever occurs first.
