NOTICE IS HEREBY GIVEN that the Board of Pharmacy has issued an Order disposing the Petition for Declaratory Statement that was filed on September 6, 2013, by Eric Renker, Pharm D., on behalf of Florida Hospital Tampa. The Notice of Petition for Declaratory Statement published on September 16, 2013, in Vol. 39, No. 189, of the Florida Administrative Register. Petitioner sought the Board’s interpretation as to whether it is in the scope and practice of a Registered Pharmacy Technician to fill and check medications which will be placed in an automated dispensing machine separate from the supervision requirement of Chapter 465.014, F.S. The Board of Pharmacy considered the Petition at its October 8, 2013 meeting.
The Board’s Order filed on October 29, 2013, denied the petition as the petition was not in substantial compliance with the provisions of Section 120.454, Florida Statutes, and Chapter 28-104, F.A.C., and the question posed is clear and did not warrant issuance of a declaratory statement.
