NOTICE IS HEREBY GIVEN that the Department of Agriculture and Consumer Services, Division of Licensing, has declined to rule on the petition for declaratory statement filed by Ronald Beermunder on December 10, 2014. The following is a summary of the agency’s declination of the petition:

Notice of the Petition for Declaratory Statement was published on December 16, 2014, in Vol. 40, No. 242 of the Florida Administrative Register. The Petition sought the Department’s opinion regarding past agency action with regard to statutes outside the agency’s authority. The Department’s order, filed on January 28, 2015, declined to answer the petition as it failed to meet the requirements for a declaratory statement pursuant to Section 120.565, FS, and Chapter 28-105, F.A.C.
