    11B-20.0014Minimum Requirements for High-Liability and Specialized Instructor Certifications

    NOTICE IS HEREBY GIVEN that on January 27, 2015, the Criminal Justice Standards and Training Commission received a petition for a permanent waiver of subparagraph 11B-20.0014(3)(a)4., F.A.C., from Kevin A. Angelilli. Petitioner wishes to waive that portion of the rule that states an applicant have successfully completed the Underwater Police Science and Technology course as a student. Petitioner states that he currently possesses and maintains a current Scuba Instructor Certification from a nationally recognized organization that meets the standards of the World Recreational Scuba Training Council (WRTC); a Dive Master Certification; and, is a member of the Professional Association of Diving Instructors (PADI). Petitioner states that he has been an instructor/trainer with PADI since 1999 and a Public Safety Diver from 1994-2013. Petitioner states that he has instructed the Underwater Police Science and Technology course within the last four years and is currently a Public Safety Diving instructor teaching at the Florida Keys Community College.

    Petitioner states he meets all requirements of the CJSTC Underwater Police Science and Technology course however, because the rule does not provide for equivalency training he is disadvantaged. Petitioner states that a strict application of the rule creates a substantial hardship and would violate principles of fairness because at the current time, the Underwater Police Science and Technology course is not being taught and he therefore cannot comply with subparagraph 11B-20.0014(3)(a)4., F.A.C. Petitioner states that the purpose of the underlying statute has been achieved by other means.
