    68A-12.002General Methods of Taking Game and Crows; Prohibitions

    PURPOSE AND EFFECT: The proposed rule amendment seeks to clarify the regulations regarding allowable methods of take during archery season. This change is consistent with the definition of the term “bow” set forth in the proposed amendment of Rule 68A-1.004. The effect of the proposed rule amendment will be to keep current methods of take during archery season in place while simplifying general definitions for archery equipment.

    SUMMARY: The proposed rule amendment prohibits the take of game during archery season by use of a bow equipped with a device that can mechanically hold the bowstring in the drawn (ready-to-fire) position (except release devices that are hand-held). The proposed rule amendment also includes a non-substantive, technical change.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    68A-12.002 General Methods of Taking Game and Crows; Prohibitions.

    (1) through (2) No change.

    (3) Resident game birds, crows or game mammals may be taken with any of the following:

    (a) through (d) No change.

    (e) Bow or crossbow, except that:

    1. through 4. No change.

    5. The take of game specified for any archery season with a bow equipped with a device that can mechanically hold the bowstring in the drawn (ready-to-fire) position is prohibited. Mechanical bowstring release devices may be used provided they are only hand-held.

    (f) No change.

    (4) through (6) No change.

    (7) The taking of fawn deer, cub bear, bear with at least one or more cub bear, panther, or swimming deer is prohibited.

    (8) through (9) No change.

    PROPOSED EFFECTIVE DATE: July 1, 2023
