    64B16-26.2032Application for Pharmacy Intern Registration

    The Board of Pharmacy hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on January 18, 2023, by Taha Al Obaidi. The Notice of Petition for Waiver or Variance was published in Volume 49, Number 13, of the January 20, 2023, Florida Administrative Register. The Petitioner was seeking a waiver of the requirement of subparagraph 64B16-26.2032(2)(b), Florida Administrative Code, which states in part that an applicant for pharmacy intern registration must submit satisfactory proof to the Board of being accepted by the Foreign Pharmacy Graduate Examination Commission to sit for the Foreign Pharmacy Graduate Equivalency Examination, or obtained a passing score on the Examination, shall be considered a graduate of an accredited college or school of pharmacy.

    The Board considered the instant Petition at a duly-noticed public meeting held February 9, 2023, in Kissimmee, Florida. The Board’s Order, filed on March 2, 2023, granted the petition, finding that Petitioner established that the purpose of the underlying statute would be met by granting a variance or waiver from subparagraph 64B16-26.2032(2)(b), Florida Administrative Code. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to Petitioner’s circumstances would violate principles of fairness and impose substantial hardship.
