64B17-3.001Licensure as a Physical Therapist by Examination

The Board of Physical Therapy hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Krzysztof S. Korthals, filed on October 8, 2013. The Notice of Petition for Variance and Waiver was published in Vol. 39, No. 197, of the October 9, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 8, 2013. The Petitioner sought a permanent variance or waiver of Rule 64B17-3.001, Florida Administrative Code, with regards to the requirement that foreign graduates receive a determination that their educational credentials are equivalent to education required for licensure as a physical therapist in the United States as determined by the appropriate credentialing agency.

The Board’s Order, filed on December 4, 2013, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that the purpose of the underlying statute has been met by other means and that application of the rule would cause a substantial hardship and would violate the principles of fairness.
