NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Amy Conchilla, P.T., on October 2, 2013. The following is a summary of the agency's disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Vol. 39, No. 196, of the October 8, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 8, 2013. The Petitioner requested the Board’s interpretation of Section 456.41, Florida Statutes, in regards to whether the term “complementary or alternative health care treatment” as defined in Section (2)(a) includes supplements and vitamins; whether a physical therapist can sell, advise, and educate clients on supplements and vitamins; and whether a physical therapist can refer clients to alternative treatment practitioners such as, but not limited to, acupuncturists, massage therapists, nutritionists, functional medicine practitioners, chiropractors, and personal trainers. The Board’s Order, filed on December 3, 2013, denies the Petition for Declaratory Statement. The Petition fails to establish Petitioner’s standing to request the Declaratory Statement. Furthermore, the Petition fails to allege any facts and circumstances particular to Petitioner as required by Section 120.565, Florida Statutes, and instead appears to be asking for a statement that has general applicability to all Physical Therapists.
