62B-33.013Permit Modifications, Time Extensions, and Renewals

The Department of Environmental Protection hereby gives notice that it has issued an order on December 19, 2013, granting Mansiana Ocean Residences, LLC’s Petition for a variance. The Petition was received on October 3, 2013. Notice of receipt of this Petition was published in the Florida Administrative Register on October 4, 2013. The petition requested a variance from subsection 62B-33.013(4), F.A.C., in order to afford additional time to complete construction of a 53-story, 275-unit condominium tower and other structures and activities authorized by the Coastal Construction Control Line permit DA-538. Subsection 62B-33.013(4), F.A.C., states that permit time extension may not be extended beyond the original three year time limit authorized in the permit time extensions/renewals are not available if a time extension was previously issued. No public comment was received. The Order, file number DA-538 V, granted the Petition to subsection 62B-33.013(4) F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
