62-610.421: Setback Distances

The Department of Environmental Protection hereby gives notice: that on December 21, 2012, the Department issued an order granting a variance to Eastpoint Water and Sewer District (Petitioner) for its Eastpoint Wastewater Treatment Facility located at Sewer Plant Road, Eastpoint, Fl 32328. The petition was received on March 25, 2011, and the notice of receipt of this petition was published in the Florida Administrative Weekly on April 15, 2011. The petition requested a variance from 62-610.421(2)(b), F.A.C. Subsection 62-610.421(2)(b), F.A.C., requires a 25 foot setback distance from slow rate land application systems to the property line when high level disinfection is provided. The petitioner is requesting a permanent variance to reduce the 25 foot setback distance to the property line to 20 feet. No public comment was received. The Order, OGC File No. 11-0543, granted the Petition for the variance to reduce the setback distance from the land application area to the property line to 20 feet, based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner had successfully fulfilled the requirements of the underlying statute.
