NOTICE IS HEREBY GIVEN that Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Saber College on October 7, 2013. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 39, No. 197, of the October 9, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 8, 2013. The Petitioner requested the Board’s interpretation of Section 486.102, Florida Statutes, in regards to the determination that Saber College’s physical therapist assistant students may be eligible for licensure pursuant to Section 486.102, Florida Statutes, as amended by Chapter 2013-093, Laws of Florida. The Board’s Order, filed on December 3, 2013, denies the Petition for Declaratory Statement. The Petition appears to be asking for a declaratory statement which would determine the conduct of another person and for a statement that has general applicability to all of Saber College’s Physical Therapist Assistant students. The Petition fails to establish Petitioner’s standing to request the Declaratory Statement. Furthermore, the Petition fails to allege any facts and circumstances particular to Petitioner as required by Section 120.565, Florida Statutes.
