The Suwannee River Water Management District (SRWMD) hereby gives notice that a final order has been issued. This Order (14-0002) grants variance under Section 120.542, F.S., to James Cornett, Cornett’s Spirit of the Suwannee, Inc., 3076 95th Drive, Live Oak, Florida 32060, for construction within the 75-foot setback from the top of the river bank within Township 1 South, Range 14 East, Section 18, Suwannee County, parcel number 18-01S-14E-0175300.0000, for ERP Number WOD-121-222085-1, Spirit of Suwannee Treehouse. The petition for variance was received by SRWMD on October 6, 2014. Notice of receipt of petition requesting variance was published in F.A.R., Volume 40, Number 202, October 16, 2014. All public comments received were in support of the project. This Order provides a variance from SRWMD criteria for subsection 40B-4.3030(13), F.A.C., for construction within the 75 foot setback from the top of the riverbank, subsection 40B-4.3030(9), F.A.C., as to the zero-rise certification requirement, and paragraph 40B-4.3030(13)(1), F.A.C., as to decks and boardwalks. SRWMD granted the petition because the petitioner has demonstrated that the purpose of the statute underlying the rule will be met and that a substantial hardship would be created if the petitioners were required to comply with this rule.
