NOTICE IS HEREBY GIVEN that the Construction Industry Licensing has issued an order disposing of the petition for declaratory statement filed by Sarah J. Keith on behalf of Apex Piping Systems, Inc., on May 27, 2016. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 42, No. 122, of the June 23, 2016, Florida Administrative Register. The Petitioner seeks a declaratory statement of the Board’s opinion as to the applicability of s. 489.105(3), F.S., as it applies to operations at a bulk storage plant and which license would be necessary to conduct such work. The Board’s Order, filed on September 20, 2016, declines to issue a declaratory statement in this matter because the petitioner is not a substantially affected party and does not have standing to request a declaratory statement, and because the petition does not relate to a particular set of circumstances.

A copy of the Order Disposing of the Petition for Declaratory Statement may be obtained by contacting: Daniel Biggins, Executive Director, Construction Industry Licensing Board, 2601 Blair Stone Road, Tallahassee, FL 32399-1039, telephone: (850)487-1395 or by electronic mail: Amanda.Wynn@myfloridalicense.com.
