    NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Daniel Arguelles on May 7, 2016. The following is a summary of the agencys disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 42, No. 122, of the June 23, 2016, Florida Administrative Register. Petitioner filed an Amended Petition on July 8, 2016. The Petitioner seeks a declaratory statement regarding Section 489.105(3), Florida Statutes, as it applies to contractors and roofers installing a hybrid solar roof and whether a Division I contractor or roofing contractor are qualified to install a Pex tubing array beneath hybrid metal pans with only a minor plumbing permit, and whether the same contractors can install Pex service lines within hybrid solar thermal roofing for hot water and/or pool heating for “future use” without being obligated to connect the lines at that time. The Construction Industry Licensing Board considered the Petition at its meeting held on July 15, 2016, in Lake Mary, Florida. The Board’s Order, filed on September 20, 2016, declines to issue a declaratory statement in that the petition relates to an ongoing controversy and that the question is already answered in statute, negating the need for a declaratory statement.
