    62B-33.024Thirty-Year Erosion Projection Procedures

    The Department of Environment Protection hereby gives notice that it issued an order on September 15, 2017, granting Destin Guardian Group, c/o Tom Patton, a Petition for a Variance. The Petition was received on June 22, 2017. Notice of receipt of this Petition was published in the Florida Administrative Register on August 17, 2017; Volume 43, Number 160. The petition requested a permanent variance or waiver from subparagraph 62B-33.024(2)(a)2, F.A.C., which sets forth a specific methodology to calculate the 30-year erosion projection for Petitioner’s property, and requests that the methodology set forth in subparagraph 62B-33.024(2)(a)3, F.A.C., be used instead. No public comments were received. The Order, file number OK-522 V; OGC Case No. 17-0881, granted the Petition for variance from subparagraph 62B-33.024(2)(a)2, F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
