PURPOSE AND EFFECT: To repeal Chapter 40E-30, F.A.C., because, the rules are unnecessary or incorporated into Chapter 40E-3, F.A.C.
SUMMARY: To repeal rule Chapter 40E-30, F.A.C., as it is either unnecessary or duplicative of the rule amendments in Chapter 40E-3, F.A.C., which went into effect on September 26, 2012, pertaining to general permits for water wells, general permits for construction, repair, or abandonment of wells, and general permits for agricultural wells within a specified area of southern Miami-Dade County that are 25 feet or less in depth.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.
A SERC has not been prepared because the District is proposing the repeal of Chapter 40E-30, F.A.C.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The District is proposing the repeal of Chapter 40E-30, F.A.C.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
