    NOTICE IS HEREBY GIVEN that Division of Licensing has received the petition for declaratory statement from Alberto E. Lugo-Janer, Esq. The petition seeks the agencys opinion as to the applicability of Section 493.6102(6), Florida Statutes, as it applies to the petitioner.

    The Division received the petition on October 6, 2015. The petition posits that, based on the language of Section 493.6102(6), Florida Statutes. Petitioner can legally perform any function of any licensee under Chapter 493, including those granted to a Statewide Firearm, Class “G” licensee, when he is acting as an attorney in the regular practice of his profession. Petitioner requests the division state whether it concurs with this conclusion. Per Rule 28-105.0027, F.A.C., except for good cause shown, petitions to intervene must be filed within 21 days of publication of this notice.
