40E-6.011: Policy and Purpose

NOTICE IS HEREBY GIVEN that on October 05, 2018, the South Florida Water Management District (District), received a petition for waiver from Florida Power & Light Company (Application No. 18-0424-4M) for utilization of Works or Lands of the District known as the L-31E Levee and C-103 Canal. The project is for an existing, single service parallel run aerial powerline and installation of a new pole within the west right of way of L-31E and south right of way of C-103 (respectively) within Section 16, Township 57 South, Range 40 East, Miami-Dade County. The petition seeks relief from Rule 40E-6.221 (3) (j), Fla. Admin. Code, which prohibits placement of parallel run facilities more than 10 feet into the canal right of way boundary, and Rule 40E-6.011(4) & (6), Fla. Admin. Code, which prohibits the placement of permanent & semi-permanent above-ground structures within 40 feet of top of canal bank within Works or Lands of the District.
