NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Joseane Estrela Stacy on June 13, 2016. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 42, No. 132, of the July 8, 2016, Florida Administrative Register. The Petitioner seeks a declaratory statement of the Board’s interpretation of 486.031(3)(b), Florida Statutes, and Rule 64B17-3.003, F.A.C., governing the issuance of a physical therapy license as applied to Petitioner’s particular circumstances. The Board’s Order, filed on August 22, 2016, declines to issue a declaratory statement in this matter because the statute and rule are clear and unambiguous as written regarding the requirements for licensure of a foreign educated physical therapist without examination.
