    NOTICE IS HEREBY GIVEN that on October 10, 2023, the Department of Environmental Protection, received a petition for a variance from Lee County Utilities. The petition requested a permanent variance from paragraph 62-521.400(1)(f), F.A.C., which prohibits the construction of Class I underground injection control (UIC) wells within a 500-foot radial setback distance around a potable water well, as regulated in Chapter 62-528, F.A.C. This request would allow the construction of a new Class I UIC well within 500 feet of a potable water well. The petition has been assigned OGC No. 23-1630.
