NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Robert J. Koning on June 21, 2011. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 37, No. 28, of the July 15, 2011, Florida Administrative Weekly. The Board considered the Petition at a duly-noticed public meeting held on August 12, 2011. The petition requested the Board’s interpretation of Part XVI of Chapter 468, Sections 468.841 and 468.8411, Florida Statutes, and whether mold related services including assessment and remediation services are within the scope of a properly licensed Division 1 contractor. The Board’s Order, filed on September 20, 2011, answers the Petition for Declaratory Statement that mold remediation and assessment is within the scope of a Division 1 contractor as long as the services are otherwise related to the contractor’s scope of work. Division 2 is not addressed with this statement.
