    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from David H. Rogel, Esq., In Re: Coco Plum Beach Yacht Club Condominium Association, Inc., Docket No. 2015044470, filed on October 6, 2015. The petition seeks the agencys opinion as to the applicability of Section 718.103(23), Florida Statutes and Section 718.111(11), Florida Statutes, as it applies to the petitioner.

    Whether the condominium is a residential condominium pursuant to Section 718.103(23), Florida Statutes? If the condominium is a residential condominium, whether the Association is obligated to maintain property insurance pursuant to Section 718.111(11), Florida Statutes? If the condominium is a non-residential condominium, whether the Association is obligated to maintain property insurance pursuant to Section 718.111(11), Florida Statutes, and/or Section 22.01 of the Declaration?
