62-701.520Special Waste Handling

The Department of Environmental Protection hereby gives notice that it has issued an order on October 12, 2015 granting Triumvirate Environmental’s Petition for a Waiver. The Petition was received on July 15, 2015. Notice of receipt of this Petition was published in the Florida Administrative Register on July 17, 2015. The petition requested a waiver from paragraph 62-701.520(5)(d), F.A.C., which requires that treated biomedical waste be disposed of only at a Class I landfill or an incinerator used to combust solid waste. No public comment was received. The Order, file number 15-0442, granted the Petition to paragraph 62-701.520(5)(d), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
