    Note of Receipt of Petition

    Petition to Amend the Boundaries of the Rivers Edge Community Development District

    On July 6, 2016, the Florida Land and Water Adjudicatory Commission (“Commission”) received an Amended and Restated Petition to Amend the Boundaries of the Rivers Edge Community Development District (“Petition”). The Commission will follow the requirements of Chapter 42-1, F.A.C., and Chapter 190, F.S., as amended, in considering the Petition.

    SUMMARY OF CONTENTS OF PETITION: The Petition proposes amendment of the Rivers Edge Community Development District (“District”) by removing approximately 2,499.74 acres (contraction parcels) from the District’s boundaries. The District was originally created through Rule Chapter 42FFF-1 and currently consists of 4,176.53 acres of land located within St. Johns County, Florida.

    SUMMARY OF ESTIMATED REGULATORY COSTS: A statement of estimated regulatory costs (SERC) was prepared at the request of the District. The complete text of the SERC is contained as Exhibit 8 to the Petition. The SERC generally finds:

    • The amendment is not expected to have any material economic impact. Impact on overall business competitiveness and/or innovation resulting from the District contraction will be negligible, if any. There are no new or additional regulatory or transaction costs expected;
    • The individuals and entities likely to be required to comply with the administrative rule or affected by the proposed action of amending the District are categorized as follows: (a) the State of Florida and its residents, (b) St. Johns County and its residents, (c) current property owners in the Modified District, (d) current property owners in the contraction area and (e) future property owners;
    • There are only modest costs expected to be incurred by the State of Florida, St. Johns County, and the property owners within the District and the contraction parcels;
    • There are no anticipated additional transactional costs associated with the adoption of an administrative rule to amend the District’s boundaries; and,
    • Amendment of the District should not have any negative impact on small businesses.
