NOTICE IS HEREBY GIVEN that the Florida Department of Corrections has declined to rule on the petition for declaratory statement filed by inmate Jason Jenkins, DC# S05703, on September 9, 2014. The following is a summary of the agency’s declination of the petition:

Inmates of the Florida Department of Corrections can only participate in administrative proceedings under §120.54(3)(c) or (7), Florida Statutes. See §120.81(3), Florida Statutes. Accordingly, the Department lacks jurisdiction to issue declaratory statements to inmates.
