40B-4.3030Conditions for Issuance of Works of the District Permits

The Suwannee River Water Management District (SRWMD) hereby gives notice that SRWMD Governing Board approved final order number 17-0006, authorizing the petition for a variance filed on June 5, 2017, and noticed in the September 1, 2017 Florida Administrative Register, Vol. 43, No. 171, to Van Humphreys, Florida Department of Transportation, 1109 South Marion Avenue, Lake City, FL, from SRWMD paragraph 40B-4.3030(1)(e), F.A.C. (Prohibiting new roads within a work of the district which at any point along the road, have a driving surface greater than one foot above adjacent natural ground elevation, or result in a net fill within the floodway); subsection 40B-4.3030(7), F.A.C. (Prohibiting fill material placed above the natural grade of the ground except for minor amounts of fill which are less than or equal to 100 square feet of the cross-sectional area of the floodway); and subsection 40B-4.3030(13), F.A.C. (prohibiting construction, additions or reconstruction in the front 75 feet of an area immediately adjacent to and including the normally recognized bank of a water). The petitioner demonstrated the variance was necessary to protect public health, safety, and welfare. The project is located in Township 3 South, Range 11 East, Sections 7 and 8, between Lafayette and Suwannee Counties and was assigned ERP-067-230260-1, CR 250 Bridge Replacement. SRWMD received no public comments regarding this project.
