NOTICE IS HEREBY GIVEN that on October 13, 2023, the Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety,, received a petition for Ybor Marti, LLC at 1200 E 7 Ave., Tampa, FL. Petitioner seeks a routine variance of the requirements of ASME A17.1, 2016 Edition, Section 2.8.1 and 2.8.2.2 as adopted by 61C-5.001, Florida Administrative Code that requires only machinery and equipment used directly in connection with the elevator shall be permitted in elevator hoistways, machinery spaces, machine rooms, control spaces, and control rooms and only such electrical wiring, raceways, cables, coaxial wiring, and antennas used directly in connection with the elevator, including wiring for signals, for communication with the car, for lighting, heating, air conditioning, and ventilating the car, for fire detecting systems, for pit sump pumps, and for heating and lighting the hoistway and/ or the machinery space, machine room, control space, or control room shall be permitted to be installed inside the hoistway, machinery space, machine room, control space, or control room which poses a significant economic/financial hardship. Any interested person may file comments within 14 days of the publication of this notice with Division of Hotels and Restaurants, Bureau of Elevator Safety, 2601 Blair Stone Road, Tallahassee, Florida 32399-1013 (VW2023-120).
