NOTICE IS HEREBY GIVEN that on October 12, 2016, the Criminal Justice Standards and Training Commission received a petition for a temporary waiver of paragraph 11B-27.00213(4)(b), F.A.C., from James Coker, Warden, Santa Rosa Correctional Institution, Florida Department of Corrections on behalf of Recruit Blake McNeil Lamar McGee. The Petitioner wishes to temporarily waive that portion of the rule that states: Agencies applying to temporarily employ or appoint an individual who has had a previous TEA registered with the Commission in the same discipline may do so only if: (a) the individual was previously certified as a full-time or part-time officer; or (b) The individual was previously hired on a TEA and has separated from the employing agency or discontinued training while in good standing, and has had a break-in-service from the last employment for a minimum of four years. Warden Coker states that Blake McGee had a family emergency that required him to move to Texas and as a result was unable to begin an academy within the 180 days of being placed into TEA status. Petitioner is requesting a second TEA status for Blake McGee to allow him the opportunity to start the Basic Recruit Training Program under TEA status. Warden Coker states that the rule creates a hardship for Recruit McGee preventing him from starting the Basic Recruit Training Program.
