Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Julio Pabon, M.D., on October 16, 2018. The Petitioner, a Florida-licensed physician who provides comprehensive fertility services through his medical practice, seeks a declaratory statement from the Board with regard to whether his proposed purchase of a limited partnership interest in Fertility Pharmacy of America, LP, and informing his patients that the Pharmacy is one of multiple pharmacies that can fill certain prescriptions constitutes a violation Section 456.053, F.S. The Board will consider this petition at its meeting currently scheduled for Friday, December 7, 2018. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
