The South Florida Water Management District (District) hereby gives notice:

On October 12, 2023, the District's Governing Board issued SFWMD Order No. 2023-054-DAO-ROW to Miami-Dade Water and Sewer Department (Application No. 220603-34657). The petition for waiver was received by the District on May 23, 2023. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Register, Vol. 49/102 on May 25, 2023, 2022. No public comment was received on this item. This Order provides a waiver of the District's criteria for the installation of a buried 14-inch parallel run sanitary sewer force main within the north right of way of the C-9 Canal; Miami-Dade County. Specifically, the Order grants a waiver from paragraph 40E-6.221(3)(j), Fla. Admin. Code, which governs the location of utility installations within 10 feet of the right of way line within Works or Lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the proposed construction will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.
