    64B16-26.2031Licensure by Examination (Non-U.S. Graduates); Application

    The Board of Pharmacy hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on August 7, 2023, by Mohamed Abuhulwa. The Notice of Petition for Waiver or Variance was published in Volume 49, Number 160 of the August 17, 2023, Florida Administrative Register. The Petitioner was seeking a waiver of the requirement of subparagraph 64B16-26.2031(2)(b)2., Florida Administrative Code, entitled, “Licensure by Examination (Non-U.S. Graduates); Application,” which requires that in addition to the requirements of subsection (1), the applicant must demonstrate proficiency in the use of English by passing the Test of English as a Foreign Language Internet-based test (TOEFL ibt) with scores of: Listening – 18; Reading – 21; Speaking – 26; and Writing – 24.

    The Board considered the instant Petition at a duly-noticed public meeting held August 25, 2023, in Jacksonville, Florida. The Board’s Order, filed on September 29, 2023, granted the petition, finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B16-26.2031, Florida Administrative Code. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to Petitioner’s circumstances would violate principles of fairness and impose substantial hardship.
