    NOTICE IS HEREBY GIVEN that the Board of Massage Therapy has issued an order disposing of the petition for declaratory statement filed by Michelle Lynn Miller-Schumacher on August 10, 2017. The following is a summary of the agency's disposition of the petition:

    The Notice of Petition for Declaratory Statement was published August 15, 2017 in Vol. 43, No. 158 of the, Florida Administrative Register. The petition seeks a declaratory statement from the Board as to whether setting up a room within a nursing and rehabilitation center to provide massage services to residents would fall under the exceptions in Section 480.046, FS, and therefore be exempt from the requirement of an establishment license. The Board’s Order, filed on October 12, 2017, finds the petition is in substantial compliance with the provision of Section 120.565, F.S., and Rule 28-105, F.A.C. Additionally, the Board finds providing massages to patients of a nursing and rehabilitation facility in a room set up for that purpose requires a massage establishment license.
