The Board of Professional Engineers hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on March 21, 2017, by Gregory B. Reinke, P.E. The Notice of Petition for Variance or Waiver was published March 29, 2017 in Vol. 43, No. 61 of the Florida Administrative Register. Petitioner sought a permanent waiver of paragraph 61G15-35.003(1)(b), F.A.C., regarding the requirements for certification as a Special Inspector. The Board considered the Petition at a duly-noticed public meeting held on April 13, 2017, in Orlando, Florida. The Board’s Order, filed on May 22, 2017, granted the Petition for permanent waiver finding the applicant met the purpose of the underlying statute by other means, in that he possesses sufficient design and inspection experience to be certified and that application of the rule’s requirements to Petitioner’s particular facts and circumstances would violate principles of fairness.
