    NOTICE IS HEREBY GIVEN THAT the Board of Clinical Laboratory Personnel has issued an order disposing of the petition for declaratory statement filed by Linda Valdes on September 01, 2009. The following is a summary of the agency's disposition of the petition:
    The Notice of Petition for Declaratory Statement published on September 25, 2009, in Vol. 35, No. 38, of the Florida Administrative Weekly. The petition seeks the Board’s interpretation of subsection 64B3-2.003(19), F.A.C., entitled, “Definititions,” asking if laboratory assistants (unlicensed laboratory personnel) can create a slide for cytology procedures or FNA’s at the patient’s bedside. The Board of Clinical Laboratory Personnel considered the Petition at a conference call held on October 16, 2009. The Board’s Order filed on October 21, 2009, stated that the Board’s opinion is that unlicensed persons cannot take a specimen and create a slide from that specimen.
