NOTICE OF CHANGE

Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 38 No. 40, October 1, 2012 issue of the Florida Administrative Register.

Paragraph (6)(f) is amended to read:

(6)(f) Test accommodation appeals procedure. An examinee who is denied test accommodations may appeal the denial to the Commissioner of Education. Such appeal may necessitate testing at a later date. The Commissioner of Education shall determine whether the Department appropriately considered the criteria set forth in paragraphs (6)(a) through (e) above.

New paragraph (a) of subsection (7) is deleted with the remaining paragraphs of subsection (7) renumbered:

(7) Scoring of the examination.

(a) If the State Board of Education revises the competencies and skills for an examination and the revisions require the State Board of Education to modify the passing scores, until the State Board adopts the modifications by rule, the Commissioner shall use calculations for scoring the assessment which adjust scores on the revised examination for statistical equivalence to scores on the former examination.
