    62-602.270Eligibility for Operator Examinations

    The Department of Environmental Protection hereby gives notice: that it has issued an order on October 18, 2019, granting the School Board of Seminole County’s Petition for a Variance. The Petition was received on August 14, 2019. Notice of Receipt of this Petition was published in the Florida Administrative Register on August 16, 2019. The petition requested a variance from paragraph 62-602.270(1)(a), F.A.C., to allow high school senior students enrolled in the Project H2O Tx learning program who have successfully completed the program to take the Level C Wastewater Exam from the Operator Certification Program prior to high school graduation. No public comment was received. The Order, OGC Case No. 19-1468, granted the Petition to paragraph 62-602.270(1)(a), F.A.C., based on a showing that the Petitioner demonstrated that a strict application of the rule would result in substantial hardship and because Petitioner demonstrated that the purpose of the underlying statute will be achieved by other means.
