NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Steven Bagenski, In Re: Venetia Condominium Association, Inc., Docket No. 2013043360, filed on October 17, 2013.The petition seeks the agency's opinion as to the applicability of section 718.112(2)(b)(2), Florida Statutes as it applies to the petitioner.

Whether Venetia Condominium Association, Inc. may vote its units under section 718.112(2)(b)(2), Florida Statutes, after the decision in Cohn v. The Grand Condo. Ass’n, Inc., 26 So. 3d 8 (Fla. 3d DCA 2009), aff’d 62 So. 3d 1120 (Fla. 2011).
