    64B8-9.0141Standards for Telemedicine Practice

    The Board of Medicine hereby gives notice that on October 22, 2015, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed on behalf of Juan Diego Oms M.D., and Larkin Community Hospital., from Rule 64B8-9.0141, F.A.C., with regard to the prescribing of controlled substances through the use of telemedicine. The Notice was published in Volume 41, No. 90, of the Florida Administrative Register, on May 8, 2015. The Board, at its meeting held on June 5, 2015, voted to deny the Petition and the Petitioner requested reconsideration of the denial. At its meeting held on October 9, 2015, the Board granted reconsideration and voted to grant the Petition for Waiver or Variance to Dr. Oms for a period of one year, finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that the purpose of the underlying statute has been met. The Board denied the waiver to Larkin Community Hospital because the rule only applies to allopathic physicians licensed pursuant to Chapter 458, Florida Statutes.
