    NOTICE IS HEREBY GIVEN that the Board of Massage Therapy has issued an order disposing of the petition for declaratory statement filed by Heather Bryan on June 18, 2015. The following is a summary of the agencys disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 41, No. 123, of the June 25, 2015, Florida Administrative Register. The petition seeks a declaratory statement from the Board as to whether a mobile massage unit used at the residence of a client or the office of a client would fall under the exceptions in Section 480.046, F.S., and therefore be exempt from the requirement of an establishment license The Board’s Order, filed on October 5, 2015, issues a declaratory statement that under the specific facts of the petition, a mobile massage unit does not fall within any of the exceptions to the requirement in Section 480.046(1)(o), F.S. that massage services be provided in licensed massage establishments.
