PURPOSE AND EFFECT: The purpose and effect of the proposed rule amendment is to update and clarify existing language and remove unnecessary language within the rule’s text.
SUMMARY: The proposed rulemaking amends Rule 61E1-1.001, F.A.C., to update and clarify existing language and remove unnecessary language within the rule’s text.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the economic review conducted by the Agency.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

61E1-1.001 Asbestos Consultants/Contractors; Licensure Requirements.

(3)(a) The Department shall accept as evidence of financial stability, as required in Section 469.005(5)(4), F.S., a statement from the applicant that he/she has not had any asbestos projects which were not satisfactorily completed and that no claims exist on asbestos projects that have been completed; and compliance with paragraph 61E1-4.001(1)(c), F.A.C.
(b) The Department shall accept as meeting the requirements of Section 469.005(6)(5), F.S., an applicant who has paid the appropriate examination fee and passed the Department administered examination set forth in Rules 61E1-2.001 through 61E1-2.005, F.A.C.
