    11D-8.014Blood Alcohol Permit - Analyst: Renewal

    The Florida Department of Law Enforcement hereby gives notice:

    On June 26, 2017, the Alcohol Testing Program of the Florida Department of Law Enforcement (ATP) issued a Final Order granting a waiver of Rule 11D-8.014, F.A.C., to Monica Escobar Jacobs. Rule 11D-8.014, F.A.C. requires blood alcohol analysts to satisfactorily determine the blood alcohol level of at least 2 proficiency samples provided by the Department semiannually to remain qualified for a permit to conduct blood alcohol analysis; the waiver permits Petitioner, who was on a leave of absence under the Family Medical Leave Act at the time of one of the proficiency cycles, to remain qualified for her permit so long as she participates in the next proficiency cycle. The Petition was filed on April 20, 2017, and notice of the petition was published on May 5, 2017, in Vol. 43, No. 88, of the Florida Administrative Register. No public comments were received. In rendering its decision, the ATP determined that Petitioner would suffer a substantial hardship were the waiver not granted as she would be unable to work until she satisfactorily participated in the next proficiency cycle. The ATP also determined that a waiver in this matter would serve the purpose of the underlying statutes as Petitioner held a current permit at the time of her petition, she will participate in all subsequent proficiency cycles, and she will undergo routine, frequent proficiency testing upon her return.
