NOTICE IS HEREBY GIVEN that on October 18, 2023, the Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety, received a petition for Mediterra Beach Club at 26110 Hickory Blvd., Bonita Springs, FL. Petitioner seeks an emergency variance of the requirements of ASME A17.1, 2016 Edition, Sections 2.4.1.5 and 2.15.9.2 as adopted by 61C-5.001, Florida Administrative Code that requires When the car is resting on its fully compressed buffers or bumpers, no part of the car, or any equipment attached thereto or equipment traveling with the car, shall strike any part of the pit or any equipment mounted therein and the guard plate shall have a straight vertical face, extending below the floor surface of the platform. A horizontal door guiding groove is permitted below the floor surface for door operating devices, door guiding devices, and door retaining devices in accordance with 2.15.9.5. The guard plate shall conform to one of the following:
(a) where the elevator is required to conform to 2.19.2.2(b) the depth of the truck zone, where provided plus 75 mm (3 in.), but in no case less than 1 220 mm (48 in.), (b) where the elevator is not required to conform to2.19.2.2(b) the depth of the leveling zone or truck zone, where provided, plus 75 mm (3 in.), but in no case less than 525 mm (21 in.) from the floor surface, which poses a significant economic/financial hardship.
